1. Introduction

Welcome to Fraterna, a private mobile application (“the App”) operated by The Builders’ Lodge No. 177 (“we”, “our”, or “us”).

These Terms and Conditions (“Terms”) govern your access to and use of Fraterna.
By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any of these Terms, you must not access or use the App.

2. Eligibility and Membership

Fraterna is intended exclusively for registered members of The Builders’ Lodge No. 177.
Access is granted only upon verification of membership credentials (e.g., name, membership number, lodge name, or authorization code). You agree not to share or transfer your account credentials to any non-member.

3. Use of the App

You agree to use the App only for lawful, organizational, and fraternal purposes consistent with lodge rules and values.
You must not:

• Use the App for commercial, political, or unlawful activities.
• Upload or share content that is offensive, defamatory, discriminatory, or infringes upon the rights of others.
• Interfere with the security, functionality, or performance of the App.
• Attempt to gain unauthorized access to any system or data.

We reserve the right to suspend or terminate your access at any time if you breach these Terms or act in a manner contrary to the spirit of the Lodge.

4. User Content

You may post or upload limited content (e.g., messages, documents, or event materials) within the App.
By submitting content, you grant The Builders’ Lodge No. 177 a non-exclusive, royalty-free, and revocable license to use that content solely for internal organizational purposes.

You remain responsible for any content you post. We may remove or restrict access to content that violates these Terms, community standards, or applicable law.

5. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using Fraterna, you consent to the practices described in that policy.

6. Intellectual Property

All content, design elements, graphics, and functionality within Fraterna are the exclusive property of The Builders’ Lodge No. 177 or its licensors. You may not reproduce, distribute, or create derivative works based on any part of the App without prior written consent.

The name “Fraterna”, associated logos, and related marks are trademarks of The Builders’ Lodge No. 177.

7. Third-Party Services

The App may use or link to third-party services such as hosting platforms, analytics providers, or payment processors. We are not responsible for the practices or content of these third-party services, which are governed by their own terms and privacy policies.

8. Payments and Fees (If Applicable)

If membership dues, event fees, or other payments are processed through the App:

• All transactions are handled securely by approved third-party payment processors (e.g., Apple Pay, Stripe, PayPal).
• You agree to provide accurate billing information.
• We do not store or manage payment card details directly.
• Payments are non-refundable unless otherwise stated.

9. Disclaimers

The App is provided “as is” and “as available.” We make no warranties, express or implied, regarding the App’s operation, availability, or suitability for any purpose. While we strive for accuracy and reliability, we do not guarantee uninterrupted service or error-free functionality.

10. Limitation of Liability

To the maximum extent permitted by law, The Builders’ Lodge No. 177, its officers, and affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use or inability to use the App. Your sole remedy for dissatisfaction with the App is to discontinue its use.

11. Indemnification

You agree to indemnify and hold harmless The Builders’ Lodge No. 177 from any claims, damages, or expenses arising from your breach of these Terms or misuse of the App.

12. Termination

We reserve the right to suspend or terminate access to Fraterna at any time without prior notice, including if:

• Your membership with the Lodge ends.
• You breach these Terms.
• We discontinue or modify the App for any reason.

Upon termination, your right to use the App immediately ceases, and stored data may be deleted in accordance with our retention policy.

13. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted in the App with an updated “Last Updated” date. Continued use of the App after such changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts of Ontario.
